Overview of service of process in Oklahoma
The Oklahoma Pleading Code in Title 12 governs procedure in the district courts of Oklahoma in all suits of a civil nature, whether cognizable at law or in equity, unless a statute specifies a different procedure. A civil action is commenced by filing a petition, after which the court clerk issues a summons. Service of process is governed mainly by 12 O.S. § 2004, which sets who may serve, the methods of service on individuals, businesses and public bodies, the mail and publication rules, the return and the 180-day service deadline. Private process servers are licensed by the district court under 12 O.S. § 158.1, and a licence is valid in every county of the state. Court Runner USA connects you with process servers who serve papers across Oklahoma.

Who can serve documents in Oklahoma
Licensing or registration requirements
At the plaintiff’s election, process other than a subpoena must be served by a sheriff or deputy sheriff, a person licensed to make service of process in civil cases, or a person specially appointed for that purpose, and the court is directed to make such special appointments freely (12 O.S. § 2004(C)(1)(a)). No prisoner, parolee or probationer under Department of Corrections supervision may be appointed to serve process (§ 2004(C)(7)).
Private process server licences are issued under 12 O.S. § 158.1 by the presiding judge of the judicial administrative district or a designated judge. An applicant must be 18 or older, of good moral character, ethically and mentally fit, an Oklahoma resident for at least six months and a resident of the county or district for at least 30 days; people convicted of a violent crime or a sex-offender-registration crime are barred. The licence requires a $150 fee, public notice, a hearing and a $5,000 bond; it is valid statewide, renewed after one year and then every three years. Knowingly serving process in Oklahoma without an Oklahoma licence is a misdemeanor, except for a server licensed in another state serving documents issued by another state’s court.

Accepted methods of service
Personal, substituted, mail and other methods
Under 12 O.S. § 2004(C)(1)(c), an individual may be served personally, by leaving copies at the dwelling house or usual place of abode with a resident who is 15 or older, by delivery to an agent authorized by appointment or by law, or by leaving copies at an agreed meeting place with a person residing at the defendant’s dwelling. Corporations, partnerships and unincorporated associations are served through an officer, a managing or general agent, or an agent authorized to receive process. The Secretary of State may be served as a corporation’s agent only when no registered agent is listed, or the agent and officers cannot be found at the registered office, after the required attempts (§ 2004(C)(4)).
Service by mail may be made by the plaintiff’s attorney, an authorized server or the court clerk, using certified mail, return receipt requested, delivery restricted to the addressee (§ 2004(C)(2)); a commercial courier or overnight service with a signed receipt may be used instead (§ 2004.3). Publication requires a verified statement that, with due diligence, the defendant cannot be served by any other method (§ 2004(C)(3)). If personal delivery and mail both fail, the court may order another method reasonably calculated to give actual notice (§ 2004(C)(6)).

Time limits and rules for serving
If a defendant is not served within 180 days after the petition is filed and the plaintiff has not shown good cause, the action is deemed dismissed without prejudice as to that defendant, and the court must enter a dismissal order within 200 days after filing in an action where no defendant has been served (12 O.S. § 2004(I)). If a timely summons is later quashed, a new summons may be served within a time the judge sets.
Unless a different time is prescribed by law, a defendant must serve an answer within 20 days after service of the summons and petition, and may file a reservation of time that extends the deadline by 20 days but waives certain defenses (12 O.S. § 2012(A)). A corporation served through the Secretary of State has 40 days after that service to answer (§ 2004(C)(4)(d)). Mail service is effective on the date of receipt or, if refused, on the date of refusal (§ 2004(C)(2)(a)). The server must make proof of service promptly and in any event within the time the person served has to respond (§ 2004(G)(1)).

Restrictions on serving
Sundays, holidays and hours
Process other than a subpoena may be served only by a sheriff or deputy, a licensed process server or a specially appointed person, and prisoners, parolees and probationers under Department of Corrections supervision may not be appointed (12 O.S. § 2004(C)). Serving process without an Oklahoma licence, or falsely claiming to be licensed, is a misdemeanor (12 O.S. § 158.1(I)).
Special defendants have their own rules: a child under 15 is served personally and through a parent or guardian, an incompetent person personally and through the guardian, and inmates through the warden, superintendent or jail administrator, who must deliver the papers promptly. Governmental bodies are served on the officer designated by statute or, absent one, the chief executive officer or records official. A default cannot rest on mail service unless the record contains a signed return receipt or a returned envelope showing refusal.
The general process statute does not address Sunday service. A habeas corpus provision allows writs and process under that article to be issued and served on Sunday in an emergency (12 O.S. § 1352); the cited sections do not establish a general Sunday rule for civil summonses.

Proof of service and affidavit requirements
The person serving process must make proof of service to the court promptly, and in any event within the time the person served has to respond; failure to make proof does not affect the validity of service (12 O.S. § 2004(G)(1)). When a sheriff or deputy serves, the court clerk sends a copy of the filed return to the plaintiff’s attorney within three days. When anyone other than a sheriff or deputy serves, the licensed process server must make an affidavit of service, and § 158.1(G) confirms that a licensed server proves service by affidavit. The return must state the county of issuance, the name of the person served, and the date, place and method of service (§ 2004(G)(2)).
For mail service, the person who mailed the papers endorses on the filed copy of the summons the date and place of mailing and the date service was receipted or rejected, and attaches the return receipt or returned envelope (§ 2004(G)(3)). A server who delivers papers personally must write the date of service on the copy left with the person served (§ 2004(D)). Service on the Secretary of State requires certified copies of the returns showing the earlier attempts (§ 2004(C)(4)). The court may allow process or proof of service to be amended unless material prejudice would result (§ 2004(H)).
